Depp Divorce and Extortion

The Johnny Depp defamation trial against his ex-wife, Amber Heard, took a turn towards divorce – and possibly extortion. According to sworn deposition testimony introduced in court, after filing for divorce Heard demanded Depp sign divorce papers and comply with her list of demands. Could a settlement letter be considered extortion?

Heard filed her petition two days after Depp’s mother passed away. At the trial, Heard’s lawyer reportedly said her client was afraid of Depp, but wanted to keep the matter private. Heard’s team was reported to have said they avoided arranging for Depp to be personally served with legal papers at one of his movie premieres.

Heard’s lawyer allegedly wrote:

“Amber wishes to work quickly towards a private and amicable resolution of all matters, but she will need Johnny’s immediate cooperation to do so.”

Heard then demanded Depp sign divorce papers and comply with a list of demands. Heard wanted him to allow her to use the black Range Rover in her possession and for him to make the payments, exclusive use and possession of three units owned by Depp in a Los Angeles building, that he continue to pay the bills, attorney fees forensic accountant fees.

A couple of days later, Heard filed for a restraining order against her then-husband claiming she was the victim of repeated domestic violence.

I have written about divorce and extortion before. It is easy to cross the line from harmless threats to the crime of extortion. The fact remains that in Florida, it is a second-degree felony to threaten to expose another for the commission of any crime or offense for one’s own pecuniary advantage.

There are several examples of how this happens in divorce. One which comes to mind, is taxes. It is not uncommon for spouses to threaten to report the other spouse to the IRS for underpayment of taxes unless money is paid to keep the silence.

Another very common extortion technique in Florida is to issue a threat to report a spouse to immigration officials. One spouse will to use the threat of deportation unless money is paid in a settlement. This was more common during the previous administration when the country cracked down on illegal immigration.

Extortion also happens when signing settlement agreements. For example, spouses sometimes threaten that if the other spouse does not sign the settlement agreement, the other spouse will tell the children about infidelity, or something else to ruin what reputation the spouse has.

Depp is suing Heard for defamation arising from a 2018 Washington Post op-ed. The article, Depp alleges, insinuated he was the perpetrator; the Oscar-winning actor claims the column made him lose job opportunities.

The letter that Heard’s divorce lawyer sent to Depp’s divorce lawyer was reportedly seen online and mentioned physical injuries Depp allegedly inflicted on Heard and noted that there were many witnesses. It mentioned a domestic violence temporary restraining order, which Heard had not yet sought to keep the issue out of the media spotlight.

Heard’s lawyer reportedly asked Depp’s lawyer to let Heard live rent-free in their apartments while Depp continued to pay the mortgage and utilities in exchange for allegedly keeping their divorce out of the media spotlight. Depp was promoting “Alice in Wonderland” at the time of the couple’s separation. The letter then listed Heard’s demands, concluding:

“We are indeed hopeful that we can swiftly work out mutually acceptable short and long term solutions outside of the public eye.”

Amber Heard’s divorce lawyer’s letter was shown in court last week as evidence in the defamation trial. Depp himself testified in court over four days about their tumultuous relationship and break-up. By the time the divorce was finalized in early 2017, Depp was on the hook for more than $14 million, according to Edward White, Depp’s business manager, who also testified.

Heard pledged to split the $7 million between donations to the ACLU and a children’s hospital. But an ACLU executive who testified this week said it received only $1.3 million of the promised $3.5 million in her name, and that $500,000 of that money actually came from Elon Musk, who Heard dated following her breakup with Depp.

Extortion and Divorce in Malibu

Kurt Rappaport, a successful realtor in Malibu California, claims his Guess-model wife, Sarah Mutch, has been trying to get him to tear up their prenuptial agreement and pay her millions in the latest example of extortion and divorce.

Rappaport filed for divorce from Canadian fashion model, Sarah Mutch, in February. In the new civil lawsuit, Rappaport alleges that after their $3 million wedding, Mutch began bitterly complaining about the terms of the prenup and demanded that he change the terms or “the marriage is over.”

The civil lawsuit goes on to allege when he refused to tear up the prenup, she went wild with his credit card, charging hundreds of thousands of dollars for various things.

The lawsuit also claims Mutch threatened that if he didn’t pay her bills, she would “release false information about him and his friends to the press and social media outlets.”

Rappaport filed a police report in April, detailing some of the alleged threats. According to the police report, obtained by TMZ, Rappaport says Mutch “threatened to fabricate a ‘Me Too’ sexual harassment report at the hands of his wealthy friends.”

He says she threatened to go to the media with the allegations if he didn’t give her “millions and millions of dollars.” He told cops she said, “If I don’t get what I want, I’m going to drop a bomb and end your career in a week!”

Rappaport says when he refused to put the property in her name or tear up the prenup during the marriage, she began berating him, calling him “selfish, cheap, greedy and disgusting.”

Mutch Ado About Nothing?

Mutch filed legal documents, also purportedly obtained by TMZ, which claim she thought they would have children and realized he had no such intention. They got into a heated argument on the way home.

She also alleges when they got home, he began screaming at her, saying all she cared about was money and she was a “greedy monster.” She says she then told him she wanted a divorce.

The legal documents also have Mutch claiming there was a pattern of verbal abuse over a period of years, alleging Rappaport tried to slam through doors when she would lock herself away from his outbursts and that she never threatened him.

Mutch is seeking temporary attorneys’ fees to determine if she could challenge their prenuptial agreement – which reportedly gives her $45,000 a month for half the duration of the marriage. The marriage only lasted 16 months. She is also is seeking an award her temporary spousal support.

Divorce Extortion

Producer and director, Stephen Belafonte, and Spice Girl Melanie Brown have a daughter together. Belafonte just gave the LAPD an audiotape of someone trying to extort him for a million dollars while he goes through his divorce.Recorded on March 20, the phone call features a woman who tells Belafonte, ‘I’m gonna take you down’ unless she’s paid $500,000 within 48 hours, a fee that’s later upped to $1m.

The woman in the recording says:

‘I want a million bucks in my account in two days otherwise you’re f***ed, it’s your choice.

 

‘I swear to God I’m gonna talk so much sh*t about you, you have no idea, it’s your choice. And it’s gonna be really really bad.’

During the call, it is also alleged ‘people’ representing Belafonte’s estranged wife Mel B asked Contreras to take the ‘ugly’ story to the media.

There can be little doubt that if Belafonte’s allegations are true, and that a spouse was recorded threatening to disclose confidential information in exchange for money, Florida’s extortion statute could cover the kind of situation facing him.

Belafonte’s Case

Contreras – who has a 12-year-old daughter Giselle with Belafonte – has denied the recording is authentic.

‘This audio is clearly not me. Stephen is falsifying stories because I have told the press the truth,’ Contreras told TMZ.

An LAPD investigative report obtained by DailyMail.com echoes TMZ, stating Contreras called Belafonte at 10pm on March 20, which is also the day Mel B filed for divorce.

In the police report filed on Thursday, the officer completing the document wrote: ‘Susp called victim and demanded $1million deposited into her account or she would disclose personal information to media.’

The alleged audio tape is the latest revelation in Mel B and Stephen Belafonte’s messy divorce proceedings, which has played out in the tabloid media since the former Spice Girl filed for divorce on March 20, citing ‘irreconcilable differences.
