Cardi B, Divorce, and Infidelity

Singer Cardi B has filed for divorce from rapper husband Offset because of his alleged infidelity. The divorce petition was filed in Georgia, and there is an initial hearing scheduled for November. Many have asked whether infidelity is grounds for a divorce.

No Longer Migos

Belcalis Marlenis Almánzar, known professionally as Cardi B, became an Internet celebrity and her debut album was number one on the Billboard 200, broke several streaming records, was certified triple platinum and named by Billboard the top female rap album of the 2010s.

Kiari Kendrell Cephus, known professionally as Offset, is a member of the hip hop and trap music trio, Migos. The couple married in 2017 in a secret ceremony.

Our relationship was so new breaking up and making up and we had a lot of growing up to do but we was so in love we didn’t want to lose each other, was one morning in September we woke up and decided to get married … No dress no make up and no ring.

Their daughter, Kulture, was born in July 2018 – Cardi B’s first child and Offset’s fourth. Cardi B is reportedly seeking primary custody, and child support from Offset.

Florida Divorce and Infidelity

I’ve written about the impact of infidelity and divorce before. In practical terms, adultery as a crime poses very little threat of prosecution, but it could have other consequences.

“Cheating on your spouse can even be grounds for losing your job. This is particularly true in the military, where adultery has a maximum punishment of a dishonorable discharge.”

Chapter 61 discusses the “the moral fitness of the parents” as one of the factors the court considers in determining the best interests of a child. Adultery may impact the division of property. Proof that one spouse intentionally wasted marital assets could be seen as dissipation of assets. Adultery of either spouse could be a factor in determining the amount of alimony, if any, to be awarded.

There are times when evidence of adultery comes into evidence. Most often it doesn’t. In 2003, the U.S. Supreme Court ruled in Lawrence v. Texas that sexual activity between consenting adults is legal.

Bad and Boujee

Their relationship has had high-profile ructions. Following rumors of Offset’s infidelity in 2017, Cardi B said:

“No, it’s not right … But what you want me to do? Start all over again and get cheated on again? This shit happens to everyone.”

The couple stayed together but briefly split in December 2018, with Cardi B saying: “Things just haven’t been working out between us for a long time … we just grew out of love.”

Offset publicly pleaded for a resolution, saying:

“I was partaking in activity that I shouldn’t have been partaking in, and I apologize. For breaking your heart, for breaking our promise, for breaking God’s promise and being a selfish, messed up husband.”

They reconciled in January 2019. But could he “walk it like I talk it?” Their divorce ends one of the highest-profile celebrity relationships in the US. Cardi B is among the world’s most successful and respected rappers – after breaking through in 2017 with US No 1 hit Bodak Yellow she has had three other No 1 singles, more than any other female rapper.

They collaborated with Cardi B on the 2017 single MotorSport. Offset has also released a successful solo album, Father of 4, featuring a hit track, Clout, with Cardi B. He has also guested on US Top 10 hits with Kodak Black and Tyga.

Divorce and Adultery May No Longer be a Thing and Good Coronavirus News

Is the coronavirus, SARS-2, SARS-CoV, Covid19 to blame? No one is sure, but British reports are showing far fewer married couples are listing “adultery” as grounds for divorce, according to new figures recently published in Britain.

Adultery Divorce Drop

Divorce Without Fault

The Sunday Times reported that the rate has dropped by more than half in a decade. According to the Office for National Statistics (ONS), it was used for 9,205 divorces in 2018, compared to 20,765 in 2008 and 36,310 in 1998.

A desire to avoid blaming the other person in a doomed marriage comes as a “no fault” divorce bill makes its way through parliament. Speaking to the paper, Sir Paul Coleridge – chairman of the Marriage Foundation – said:

“I think people are more grown up than they used to be and realize that a single act of adultery does not tell you very much about the cause of the break-up of a marriage. It may be a symptom of the problem, but my experience is that it isn’t the cause. The cause is the broken relationship, and the adultery arises out of it.”

According to the ONS, the most common grounds for divorce – used in half of all cases, compared to one in ten for adultery – is unreasonable behavior.

It comes as it was revealed that suspicious partners can order DNA ‘infidelity’ tests online to prove whether their other halves have really strayed.

The ‘evidence’ – such as underwear, bedding, condoms, cigarette butts, strands of hair or chewing gum – is sent off to a lab for analysis

The Sunday Times previously reported that one UK-based company is offering a £90 “semen detection test”, a £299 “gender” test to check if the sample is from a man or a woman, or a £500 comparison test to differentiate between their own sample and a “suspicious” one.

They also found a £60 “sperm detection kit” sold online – containing a solution that turns samples purple if semen is present – which is being sold as a way to catch a “cheating spouse”.

Florida No Fault Divorce

I’ve written about no fault divorce before. No-fault laws are the result of trying to change the way divorces played out in court. In Florida no fault laws have reduced the number of feuding couples who felt the need to resort to distorted facts, lies, and the need to focus the trial on who did what to whom.

Florida abolished fault as grounds for filing a divorce. Gone are the days when you had to prove adultery, desertion or unreasonable behavior as in England.

The only ground you need to file for divorce in Florida is to prove your marriage is “irretrievably broken.” Additionally, the mental incapacity of one of the parties, where the party was adjudged incapacitated for the prior three year, is another avenue.

Adultery can be the cause of a divorce, but can it impact the outcome? Since Florida became a no-fault state, the fact that, “she (or he) is sleeping with a co-worker” doesn’t hold much traction in court any more.

When is adultery relevant in divorce in Florida? Although we are a no-fault state, there is still a statutory basis for infidelity to be an issue in your divorce proceedings, but not as a reason for divorce.

Some people think no fault divorce is one of the main reasons for a high divorce rate. Despite the recent legislative moves in the UK, there is a movement here to return to the old “fault” system to promote families.

Good News and the Coronavirus

  • Did you know that “2019-nCOV” was the initial name given for the virus?

But the name was hard to remember and was misleading, because it gave the misimpression that the virus was novel. It’s not. In fact, it’s the least novel of the respiratory disease-causing viruses. It’s defining feature is its NON-novelty!

  • Do you know how to kill the coronavirus?

Since it is an enveloped virus, it’s killed by soap/detergents, ethanol, Windex (which contains detergents), and bleach.

  • Do you know how long the coronavirus lasts on surfaces?

On steel and plastic, 10-fold drop in ~12 hours; On cardboard, about 1 hour; On a napkin, the survival should be like on cardboard or maybe lower, and the virus will get trapped by the paper fibers. That said, don’t wipe your mouth with a napkin that someone just handed you.

  • Does “social distancing” have any effects?

The R0 rate (“R zero rate”) refers to how contagious an infectious disease is. Preemptive hygiene enhancement and social distancing help reduce the average frequency and intensity of exposure to the virus, might reduce infection risk, reduce the average viral infectious dose of those exposed, and result in less severe cases who are less infectious.

  • Is there a cure for the Covid-19 disease?

Right now people are working on it. But thanks to earlier research, we may already have drugs with activity against it. For example, Remdesivir (Gilead) seems to work against SARS-CoV-2 in cells.

Divorce Infidelity and Gender

With one in five British adults admitting to cheating on their partners, monogamy is clearly not as straightforward a concept for some as it is for others. Could the impact of an affair differ based on your sex? Divorce, infidelity and gender is the topic of a recent report from England.

divorce infidelity and gender

Seven Year Itch

As the Independent reports, divorce, infidelity and gender studies have revealed that men may have a greater tendency than women to go ahead with or contemplate committing adultery in heterosexual relationships.

In fact, recent research has shown that they can be less forgiving than their female counterparts when considering divorce on account of infidelity. New research conducted into behavioral patterns that can lead to divorce, coming to illuminating conclusions about the impact of adulterous conduct on marital bliss.

According to the findings, almost a third of divorces occur when men and women have forgiven past wrongdoings but have finally “run out of patience.”

This bad behavior refers to a number of issues, including adultery, financial problems and substance abuse. Interestingly, some people are finding that women are more likely than men to try to salvage a broken marriage, despite their partner’s unfaithfulness.

Florida Divorce and Infidelity

I’ve written about divorce infidelity and gender issues before, but not specifically how men and women differ in the impact of an affair. One reason is that in Florida, we have no-fault divorce laws. No-fault divorce laws are the result of trying to change the way divorces played out in court.

In Florida no fault laws have reduced the number of feuding couples who felt the need to resort to distorted facts, lies, and the need to focus the trial on who did what to whom.

Indecent Proposal

Adultery can be the cause of a divorce, but can divorce, infidelity and gender impact the outcome? Since Florida became a no-fault state, the fact that, “she (or he) is sleeping with a co-worker” doesn’t hold much traction in court any more.

When is adultery relevant in divorce in Florida? Although we are a no-fault state, there is still a statutory basis for infidelity to be an issue in your divorce proceedings, but not as a reason for divorce.

Unfaithful

According to the Independent, researchers were surprised time and again by the ability of some men and women to almost turn a blind eye to their partner’s misbehavior.

However, the cases show how many people in such a situation find their patience ultimately exhausted, usually when the misconduct becomes too difficult for themselves and others to ignore.

“In some cases, that means being told by friends and relatives about extra-marital affairs which they were already aware of or discovering the true extent of a spouse’s financial difficulties and learning that they impact on a business as well as at home.”

On the other hand, the odds of men tolerating their wives’ dishonesty are far lower than the other way around.

Fatal Attraction

In Britain last year, the Office of National Statistics stated that the number of women petitioning for divorce against their husbands as a consequence of their spouses’ misconduct had decreased by 43 percent since 1996.

Meanwhile the number of men divorcing their wives for the same reason had increased by approximately by a third.

Some speculate that the main reason why men and women are willing to give their marriages another go is due to the negative effect separating will have on their children.

Divorce, infidelity and gender studies are surprising people in how different genders react. Arguably the principal factor in staying together is a desire to remain married for the sake of their children. Once those children have left home, a number of unhappy parents decide to take advantage of what they regard as an opportunity to leave a troubled marriage.
